1. Overview

These Terms & Conditions govern your use of the services provided by Panama Publishing. By engaging our services or using our website, you agree to the terms outlined below.

Our goal is to provide transparent, professional publishing support services while protecting both client and company interests.

2. Scope of Services

Panama Publishing provides professional publishing support services, which may include editing, formatting, design, publishing guidance, and related creative services.

All services are performed based on the project scope agreed upon in writing before work begins.

We do not guarantee specific commercial outcomes, including but not limited to book sales, rankings, distribution approvals, or marketing performance.

3. Ownership & Intellectual Property

Upon full payment for completed services:

  • Clients receive full ownership rights to the final custom deliverables created specifically for their project.
  • Ownership does not extend to licensed third-party materials, stock images, fonts, templates, or software elements unless explicitly stated.
  • The client is responsible for ensuring they have the legal right to use all content they submit.

Panama Publishing retains the right to display completed work in its portfolio unless otherwise agreed in writing.

4. Payment Terms

Payment structure will be clearly outlined before the project begins. Depending on the service scope, we may require:

  • Full payment in advance, or
  • Milestone-based payments

All payments must be made before the corresponding phase of work begins. Applicable taxes and transaction fees are the responsibility of the client.

5. Revision Policy

We provide revisions according to the agreed project scope.

Standard revision window: 14 days from delivery of the draft.

Turnaround times:

  • 24-hour urgency projects: 24-hour revision turnaround
  • 24 to 48-hour projects: 48-hour revision turnaround
  • Projects exceeding 48 hours: 72-hour revision turnaround

Revision timelines may vary depending on project complexity. Revisions outside the original scope may incur additional fees.

6. Refund Policy

A. Before Work Begins

Clients may request a full refund before work has started. Transaction processing fees may be deducted (up to $150 or 10% of the total purchase price, whichever is lower).

B. After Work Has Begun

  • If manuscript/content has been submitted but design or production has not started: Up to 75% refund of the remaining unused portion.
  • If design or production work has started but final approval has not been granted: Up to 50% refund of the remaining unused portion.

Refund eligibility is determined based on documented project milestones.

C. After Final Approval

No refunds will be issued after the client provides final written approval of completed work.

D. Refund Request Window

Refund requests must be submitted in writing within 7 calendar days of project delivery. Refunds, if approved, are processed within 14 business days.

E. Non-Refundable Situations

  • Change of mind after work has started
  • Delays caused by lack of client communication
  • Completed services approved by the client
  • Services delivered according to agreed scope

7. Client Responsibilities

Clients agree to:

  • Provide accurate and lawful content
  • Respond to communication in a timely manner
  • Ensure submitted material does not infringe on third-party rights

Clients are solely responsible for the originality and legality of the material they provide.

8. Limitation of Liability

Panama Publishing provides services in good faith and with reasonable professional care.

  • We do not guarantee uninterrupted website operation.
  • We are not responsible for third-party platform decisions, delays, or distribution approvals.
  • We are not liable for indirect, incidental, or consequential damages arising from service use.

Our total liability shall not exceed the amount paid for the specific service in dispute.

9. Indemnification

You agree to indemnify and hold Panama Publishing harmless from any third-party claims, damages, or expenses arising from:

  • Content you provide
  • Violation of intellectual property rights
  • Misuse of our services
  • Breach of these Terms

10. No Partnership

Engaging our services does not create a partnership, joint venture, employment relationship, or agency relationship.

11. Email & SMS Communication Policy

By providing your email address and/or mobile phone number, you consent to receive communications related to your services.

A. Types of Messages

  • Transactional messages (project updates, invoices, revisions)
  • Optional promotional communications (if subscribed)

B. Message Frequency

Message frequency varies depending on project activity and communication needs.

C. Opt-Out Instructions

Email: Click the "unsubscribe" link at the bottom of any email.

SMS: Reply "STOP" to unsubscribe. You will receive a confirmation message and no further SMS communications.

D. Charges

Standard message and data rates may apply depending on your carrier.

E. Privacy

We do not sell or share your personal information with third parties without consent, except as required by law. Please review our Privacy Policy for detailed information.

F. Compliance

We comply with applicable messaging regulations, including US A2P 10DLC (The Campaign Registry) and relevant anti-spam laws in the United States and Canada.

12. Modifications

We reserve the right to update these Terms & Conditions at any time. Updates will be posted on this page with a revised effective date. Continued use of our services constitutes acceptance of the updated terms.
